General Terms and Conditions

Effective Date of the General Terms and Conditions: 2026.09.16.

Using the Professional Parts Finder

The selection and ordering of parts in the webshop requires professional knowledge; please take this into consideration!

After selecting the vehicle data (manufacturer, model, type, engine/trim), the product search results list obtained after choosing the appropriate article group does not correspond to a uniquely identified vehicle, but rather to a model produced in multiple versions. Equipment levels, individually ordered extras, and potential custom modifications can all influence which part number from the search results list is suitable for you. We recommend using original equipment manufacturer (OEM) part numbers, as these guarantee an exact match according to the vehicle identification number (VIN).

If you cannot find the desired part in our webshop, it is advisable to send an email (info@jpparts.eu) with your vehicle's details (including the VIN) and a description of the part you are looking for; we will assist you with the selection.

When placing an order, please note that the statutory Right of Withdrawal period is 14 days. Please ensure the suitability of the part before this deadline expires, so that in the event of an incorrect order, we can smoothly process the return or exchange of the product.

In order to ensure the professional and safe installation of vehicle parts, the Service Provider recommends that installation be carried out by a qualified professional. Before installation, it is advisable to check the product's suitability (e.g., by comparing it with the removed part). The Service Provider is not liable for malfunctions and damages resulting from improper or unprofessional installation, provided they are not attributable to a manufacturing defect of the product.

The contract concluded by placing an order in the webshop is not considered a written contract, it is not registered, it is formed by implied conduct. The language of the contract and customer communication is English and Hungarian. The original Hungarian version remains authoritative in accordance with applicable Hungarian law. It does not refer to a code of conduct. The Service Provider processes and records electronic data related to the order and the conclusion of the contract within the retention period specified by the relevant accounting and data protection regulations. For any questions regarding the operation of the webshop, the ordering, and delivery process, we are available at our provided contact details.

The scope of these General Terms and Conditions extends to legal relationships arising on the Service Provider's website (https://jpparts.eu) and its subdomains. These General Terms and Conditions are continuously available (and can be downloaded, printed at any time) from the following website: https://jpparts.eu/en/terms

2. FUNDAMENTAL PROVISIONS

2.1. For questions not regulated in these General Terms and Conditions, and for the interpretation of these General Terms and Conditions, Hungarian law shall apply, with particular regard to Act V of 2013 on the Civil Code ("Civil Code"), Act CVIII of 2001 on certain issues of electronic commerce services and information society services ("E-commerce Act"), as well as the provisions of Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and traders. For special products, the relevant sectoral legal provisions shall apply. The mandatory provisions of the relevant legislation shall apply to the parties without any specific stipulation.

2.2. These General Terms and Conditions are effective from September 16, 2026, and shall remain in force until revoked. The Service Provider shall publish amendments to these General Terms and Conditions on the website and shall notify registered Users and/or Users who have previously made a purchase of the changes via email. The amendments do not affect contracts concluded previously, meaning the amendments have no retroactive effect.

2.3. The Service Provider reserves all rights regarding the website, any part thereof, the content appearing thereon, and the distribution of the website. It is prohibited to download, electronically store, process, or sell any content appearing on the website or any part thereof without the Service Provider's written consent (with the exception of this document and the data processing policy).

2.4. The Service Provider assumes no responsibility for the sale and purchase of products published on other websites not attributable to or operated by the Service Provider.

3. REGISTRATION / PURCHASE

3.1. In the event of false data or data attributable to another person being provided during the use/ordering/subscription of the service, the resulting electronic contract may be challenged in court by the entitled party. As a result of a successful challenge (winning the lawsuit), the contract becomes invalid from the date of its conclusion, or if it conceals another contract, the rights and obligations of the parties shall be judged based on the concealed contract.

3.2. The Service Provider shall not be liable for any delivery delays or other problems or errors attributable to incorrect and/or inaccurate data provided by the User. However, the Service Provider informs Users that after consultation with the User and clear identification, it may correct incorrectly entered data in the order to ensure that invoicing and delivery are not hindered.

3.3. The Service Provider shall not be liable for damages arising from the User forgetting their password, or if it becomes accessible to unauthorized persons for any reason not attributable to the Service Provider (if registration is available on the site).

4. SCOPE OF PRODUCTS AND SERVICES AVAILABLE FOR PURCHASE, AND PRICES

4.1. The products displayed can be ordered online (in some cases by phone) from the webshop. Prices displayed for the products are indicated and payable in EUR or HUF (including VAT) as selected by the customer. These are gross prices (i.e., they include the statutory VAT, or if the Service Provider invoices VAT-exempt, the prices are the amounts payable), but they do not include shipping or payment-related fees. No separate packaging costs are charged, unless the User requests gift or other special packaging.

4.2. In the webshop, the Service Provider details the product name, description, and displays a photo of the products (if available).

4.3. Should a promotional price be introduced, the Service Provider shall fully inform Users about the promotion and its exact duration. When determining promotional prices, the Service Provider acts lawfully, complying with the rules of Joint Decree 4/2009 (I. 30.) NFGM-SZMM on the detailed rules for indicating the selling price and unit price of products, and the fees for services.

4.4. In the event of an incorrect price being displayed, the Service Provider is not obliged to confirm the order at that price. Instead, the Service Provider has the option to reject the offer and propose confirmation at the correct, actual price, in which case the User has the right to

  • not accept the modified offer and cancel the order.
  • maintain their order at the correct price.

Pursuant to Act V of 2013 on the Civil Code (Ptk.), a contract is formed by the mutual and concordant expression of the parties' will. If the parties cannot agree on the contractual terms, i.e., there is no declaration mutually and concordantly expressing the parties' will, then a validly concluded contract from which rights and obligations would arise cannot be spoken of.

An incorrect price is considered to be:

  • a selling price of 0 HUF or 1 HUF;
  • a price that is strikingly disproportionate to the product's well-known market value, resulting from a typo or system error (e.g., displaying a 150,000 HUF original part for 1,500 HUF).

5. ORDERING PROCESS

Credit Card Payment with Revolut: jpparts.eu does not transfer any personal data to the payment service provider, only the amount to be paid. Secure payment takes place on the financial service provider's own interface; financial data and card details are not returned to the website (jpparts.eu) operator, only the payment status and, if successful, its transaction ID.

5.5.2. Delivery Methods and Costs:

On the checkout page, the customer can select the desired shipping service provider. Based on the weight and dimensions of the products in the cart and the specified delivery address, the system accurately calculates the estimated delivery time and shipping fee.

For items ordered on request, the customer has the option to postpone the selection and payment of the shipping method.

Statutory Postal Delivery Information (Government Decree 335/2012. (XII. 4.)): In addition to its contracted express courier partners (FedEx, TNT Express, DHL Express), the webshop also provides the option to select delivery services offered by the universal postal service provider (Magyar Posta Zrt. – MPL) on the checkout interface, according to the current official and published tariffs.

5.6. The final amount payable, based on the order summary and confirmation email, includes all costs. In accordance with Section 6:127 of the Civil Code, the User is obliged to promptly verify that the quality and quantity of the ordered product(s) are satisfactory. Product(s) are delivered on business days between 8 AM and 5 PM.

5.7. After entering the data, the User can submit their order by clicking the 'Order with Payment Obligation' button. Before doing so, the User can re-check the entered data, send a comment with their order, or notify us via email of any other order-related requests.

5.8. By placing an order, the User acknowledges that a payment obligation arises in accordance with Section 15 and other conditions (e.g., Section 20) of Government Decree 45/2014. (II. 26.).

5.9. Correction of data entry errors: Before completing the ordering process, the User can always return to the previous phase to correct the entered data. In detail: During the order process, it is possible to view and modify the contents of the shopping cart. If the cart does not contain the desired quantity, the User can enter the desired quantity in the data entry field in the quantity column, then press the "+/-" button. If the User wishes to delete products from the cart, they click on the "X" "delete" button. Throughout the order process, the User continuously has the opportunity to correct/delete the entered data. The User also has the option to request correction of any errors by phone or email after submitting the order.

5.10. The User receives an email confirmation after submitting the order. If this confirmation does not reach the User within an expected timeframe depending on the nature of the service, but no later than 48 hours from the submission of the User's order, the User is released from their offer or contractual obligation. The order and its confirmation are considered to have reached the Service Provider and the User when they become accessible to them. The Service Provider excludes its liability for confirmation if the confirmation does not arrive on time because the User provided an incorrect email address during registration, or cannot receive messages due to the mailbox associated with their account being full.

5.11. The User acknowledges that the confirmation mentioned in the previous point is merely an automatic confirmation and does not constitute a contract. The contract is formed when the Service Provider, following the automatic confirmation mentioned in the previous point, notifies the User in a separate email about the details of the order and its expected fulfillment.

5.12. Publication of Customer Reviews, Rules: Our webshop exclusively features consumer reviews submitted by consumers who have purchased or used the product. We do not filter reviews in such a way as to display only positive reviews. It is strictly forbidden to publish false consumer reviews or recommendations for the purpose of promoting our products.

5.14. Order-Related Emails, Statuses

After placing your order on our website, you will receive three emails from us regarding the different stages of your order.

Email with the subject line 'Order Information':

This first, automatically generated message indicates that your order has been received by our system. The email contains the data you provided – such as the order ID, date, list of ordered products, quantity, prices, shipping cost, and the total amount payable.

If you notice any errors in the data, please notify us immediately by email and also send us the correct data.

If this automatic confirmation email does not arrive within 24 hours, please contact us, as it is possible that the order was not registered in our system due to a technical error.

Email with the subject line 'Shipping Information – JP Parts':

In the second message, we will inform you about the expected shipping date.

Important to know: the first two emails – 'Order Information' and 'Shipping Information – JP Parts' – do not constitute acceptance of the order and do not create a binding contract between you and LusteeNet Outdoor Adventure Kft. (JP Parts).

Email with the subject line 'Order Confirmation – Information on Your Order Status – JP Parts':

This third message is the official confirmation of the order. With this, the Trader accepts your offer, thereby creating a binding contract between you and the Trader.

5.15. You can download our sample Right of Withdrawal form from the following page: Sample Right of Withdrawal Form (view at the bottom of the page)

6. ORDER PROCESSING AND FULFILLMENT

6.1. Orders are processed on business days, during working hours, in the order of their receipt. Orders can also be placed outside the designated processing times; if an order is placed after working hours, it will be processed on the next business day. The Service Provider's customer service will always confirm electronically when your order can be fulfilled.

6.2. The general delivery deadline is within 1-5 business days from the conclusion of the contract, unless a longer delivery time was indicated for the specific product on the Website, in which case that longer period shall apply.

6.3. Based on the sales contract, the Service Provider is obliged to transfer ownership of the item, and the User is obliged to pay the purchase price and take delivery of the item.

6.4. If the seller is a Trader and the buyer is a Consumer, and the seller undertakes to deliver the item to the buyer, the risk of damage transfers to the buyer when the buyer or a third party designated by them takes possession of the item. The risk of damage transfers to the buyer upon handover to the carrier if the carrier was commissioned by the buyer, provided that the carrier was not recommended by the seller.

6.5. The obligor is in default if they fail to perform the service when due. If the obligor is in default, the obligee may demand performance, or if their interest in the performance of the contract has ceased due to the delay, they may withdraw from the contract. In case of delay by the Service Provider, the User is entitled to set an additional deadline. If the seller fails to perform within the additional deadline, the buyer is entitled to withdraw from the contract.

6.6. The User is entitled to withdraw from the contract without setting an additional deadline if:

  1. the Service Provider has refused to perform the contract; or
  2. the contract should have been performed at the specified time – and not at any other time – either by agreement of the parties or due to the discernible purpose of the service.

If the Service Provider is in default, the User may demand performance, or if their interest in the performance of the contract has ceased due to the delay, they may withdraw from the contract.

The User is not required to prove that their interest in performance has ceased if:

  1. the contract should have been performed at the specified time – and not at any other time – either by agreement of the parties or by virtue of the discernible purpose of the service; or
  2. the entitled party set a suitable additional deadline for subsequent performance, and this additional deadline expired without result.

6.7. If the Trader fails to perform its contractual obligation because the product specified in the contract is not available, it is obliged to immediately inform the Consumer thereof, and to immediately refund the amount paid by the Consumer, and furthermore, the Trader is obliged to ensure that the Consumer asserts their other rights provided by law in case of defective performance.

6.8. The Trader draws the Consumers' attention to the fact that by finalizing the order, a binding sales contract is concluded between the parties, under which the Trader is obliged to hand over the product, and the Consumer is obliged to pay the purchase price and shipping costs, and to take delivery of the product (Section 6:215 of the Civil Code).

If, despite notifications, the Consumer unjustifiably fails to take delivery of a shipment dispatched in accordance with the contract, without a prior legal declaration (right of withdrawal) (the package returns to the sender with the indication "delivery refused" or "unclaimed"), the Consumer falls into default of acceptance and commits a breach of contract, in accordance with Section 6:156 (1) of the Civil Code.

In this case, the Trader is entitled to claim its proven and directly incurred damages in connection with the breach of contract – especially the direct freight charges for the failed outbound and return delivery, as well as its proven and directly incurred costs in connection with the breach of contract – from the Consumer, based on the compensation rules of Section 6:142 of the Civil Code.

7. RIGHT OF WITHDRAWAL

7.1. In accordance with Directive 2011/83/EU of the European Parliament and of the Council, and Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and traders, the Consumer is entitled to a right of withdrawal without giving any reason.

The consumer may exercise their right of withdrawal or termination

  1. in the case of a contract for the sale of goods:
    1. for the product,
    2. in the case of the sale of multiple products where the delivery of individual products occurs at different times, for the last product delivered,
    3. in the case of a product consisting of multiple lots or pieces, for the last lot or piece delivered,
    4. if the product is to be supplied regularly over a specified period, for the first supply,
    within fourteen days from the date of receipt by the consumer or a third party designated by them, other than the carrier.

If the Service Provider provides services, the consumer may exercise their right of withdrawal or termination in the case of a contract for the provision of services within fourteen days from the date of conclusion of the contract.

If the Service Provider fails to provide the present information, the 14-day withdrawal period shall be extended by twelve months. If the Service Provider provides the information after the expiry of 14 days from the date of receipt of the product or conclusion of the contract, but within 12 months, the period for withdrawal shall be 14 days from the date of communication of this information.

7.2. The Consumer may exercise their right of withdrawal by means of a clear statement to that effect, or by using the declaration template specified in Annex 2 of Government Decree 45/2014 (II.26.), or by using the withdrawal function.

7.3. The period for exercising the right of withdrawal expires 14 days after the day on which the Consumer or a third party designated by them, other than the carrier, takes possession of the product.

7.4. The Consumer may also exercise their right of withdrawal in the period between the date of conclusion of the contract and the date of receipt of the product.

7.5. The direct cost of returning the product must be borne by the Consumer; the Service Provider has not undertaken to bear this cost.

7.6. In the event of exercising the Right of Withdrawal, the Consumer shall not be charged any costs other than the cost of returning the product.

7.7. The Consumer does not have the Right of Withdrawal in the case of non-prefabricated goods produced according to the Consumer's instructions or at their express request, or in the case of a product clearly tailored to the Consumer's personal specifications (Government Decree 45/2014 (II. 26.) Section 29 (1) c)). The exception under Section 29 (1) c) of Government Decree 45/2014 applies exclusively to parts manufactured individually based on the consumer's specific instructions or uniquely coded to the chassis number (VIN) (e.g., vehicle-specific factory keys, lock sets, immobilizers or control units assigned to a chassis number). The statutory 14-day Right of Withdrawal extends to mass-produced, standard parts – even if their selection was based on a chassis number.

Rules for Rare, Factory-Ordered Parts and B2B Purchases:

  • Non-private customers (Businesses, service centers): The 14-day right of withdrawal without justification, based on the Civil Code and Government Decree 45/2014. (II. 26.), applies exclusively to natural persons (Consumers) acting outside their profession. The right of withdrawal does not legally extend to orders placed by business associations, sole proprietors, or other legal entities (customers with a tax number).
  • Ordering serial, but rare parts: For rare parts or parts belonging to older types, procured from foreign factory orders specifically at the customer's request, we kindly ask you to carefully verify compatibility with our customer service (based on VIN/chassis number) before placing your order, as avoiding incorrect orders is in our mutual interest.
  • Depreciation (installed or damaged parts): The Consumer is liable for any depreciation resulting from use exceeding what is necessary to ascertain the nature, characteristics, and functioning of the product (Government Decree 45/2014. (II. 26.) Section 25). The Consumer is exclusively liable for any depreciation resulting from use exceeding what is necessary to ascertain the nature, characteristics, and functioning of the product (Government Decree 45/2014. (II. 26.) Section 25). If the product is damaged, incomplete, or worn beyond the extent necessary for testing upon return, the Service Provider is entitled to claim an amount proportionate to the depreciation.

7.8. The Consumer may also not exercise their Right of Withdrawal (full list of exceptions based on the regulation, Section 29 (1)):

  1. in the case of a contract for the provision of services, after the service has been fully performed; however, if the contract creates a payment obligation for the consumer, only if the performance commenced with the consumer's express prior consent and acknowledgment that they will lose their Right of Withdrawal once the Trader has fully performed the contract;
  2. in respect of goods or services whose price or fee depends on fluctuations in the financial market that cannot be influenced by the Trader, even within the period specified in Section 20 (2);
  3. in the case of non-prefabricated goods manufactured according to the consumer's instructions or at their express request, or goods clearly tailored to the consumer's personal needs;
  4. in respect of perishable goods or goods with a short shelf life;
  5. in respect of sealed goods which are not suitable for return due to health protection or hygiene reasons if unsealed after delivery;
  6. in respect of goods which, by their nature, are inseparably mixed with other goods after delivery;
  7. in respect of alcoholic beverages whose actual value depends on market fluctuations that cannot be influenced by the Trader, and whose price was agreed upon by the parties at the time of concluding the sales contract, but whose performance only takes place after the thirtieth day following the conclusion of the contract;
  8. in the case of a service contract where the Trader visits the consumer at the consumer's express request to carry out urgent repair or maintenance work;
  9. in respect of the sale of sealed audio or video recordings, or computer software, if the consumer has unsealed the packaging after delivery;
  10. in respect of newspapers, periodicals, and magazines, with the exception of subscription contracts;
  11. in the case of contracts concluded at a public auction;
  12. in the case of a contract for the provision of accommodation other than for residential purposes, transport, car rental services, catering, or services related to leisure activities, if a specific date or period for performance is stipulated in the contract;
  1. in respect of digital content not supplied on a tangible medium, if the Trader has commenced performance with the Consumer's express prior consent, and the Consumer, by giving such consent, simultaneously acknowledged that they would lose their right of withdrawal/termination under Section 20 after the commencement of performance, and the Trader has sent a confirmation to the Consumer in accordance with Section 12 (2) or Section 18.

7.9. In the event of withdrawal from a distance contract, the Service Provider shall refund the full amount paid by the Consumer as consideration, including costs incurred in connection with performance, without undue delay, but no later than fourteen days from becoming aware of the withdrawal. However, the Service Provider is entitled to a right of retention.

7.10. During the refund process, the Service Provider shall use the same payment method as that used for the original transaction, unless the Consumer expressly consents to the use of a different payment method; the Consumer shall not incur any additional costs as a result of using such a refund method.

7.11. The Consumer shall return or hand over the goods to the Service Provider without undue delay, and in no event later than 14 days from the date of sending the notification of withdrawal from the contract to the Service Provider. If the Trader also sells the goods in a physical store, and the Consumer exercises their Right of Withdrawal in person at the Trader's premises, they are entitled to return the goods to the Trader at the same time.

7.12. In case of written withdrawal, it is sufficient for the Consumer to send the declaration of withdrawal within 14 days.

7.13. The Consumer shall be deemed to have complied with the deadline if they return or hand over the product(s) before the expiry of the 14-day period. The return shall be considered timely if the Consumer dispatches the product before the deadline expires.

7.14. The Consumer shall bear only the direct cost of returning the product.

7.15. The Service Provider is not obliged to reimburse the Consumer for any additional costs resulting from the Consumer choosing a delivery method other than the least expensive standard delivery method offered by the Service Provider.

7.16. The Service Provider may withhold the refund until it has received the goods back or the Consumer has supplied proof of having sent them back, whichever is the earliest.

7.17. If the Consumer wishes to exercise their Right of Withdrawal, they may notify the Service Provider using any of the contact details provided, either in writing (even using the attached declaration form), by phone, by using the withdrawal function, or even in person. For written notifications, the date of mailing / handover to courier / sending the email shall be taken into account, and for phone notifications, the date of the phone call.

7.18. The Consumer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

7.19. Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses (hereinafter: the Decree) is available here.

7.20. Directive 2011/83/EU of the European Parliament and of the Council is available here.

7.21. The Consumer may also contact the Service Provider with other complaints using the contact details provided in these Regulations.

7.22. The Right of Withdrawal only applies to Users who qualify as Consumers under the Civil Code.

7.23. The Right of Withdrawal does not apply to a business, i.e., a person acting within the scope of their profession, self-employment, or business activity.

7.24. (Applicable only if the Service Provider also provides services in addition to sales.)

If the Consumer terminates a distance contract after the commencement of performance, they are obliged to pay the Trader a proportionate fee for the service performed up to the time of communicating the termination to the Trader. The amount to be paid proportionately by the Consumer shall be determined based on the full amount of the consideration, including tax, as stipulated in the contract. If the Consumer proves that the total amount determined in this manner is excessively high, the proportionate amount shall be calculated based on the market value of the services performed up to the time of termination of the contract. When determining the market value, the consideration for identical services provided by traders performing identical activities at the time of concluding the contract shall be taken into account.

In exercising their right of withdrawal/termination, the consumer shall not bear the following costs:

  1. the full or partial costs of performance of a service contract, if
    1. the Trader failed to comply with its information obligation as prescribed in Article 11 (1) (i) or (k) of the Regulation, or
    2. the Consumer did not request the commencement of service performance pursuant to Articles 13 and 19 of the Regulation before the expiry of the deadline specified in Article 20 (2) of the Regulation;
  2. the full or partial costs of providing digital content not supplied on a tangible medium, if
    1. the Consumer did not give their explicit prior consent for the performance to begin before the expiry of the deadline specified in Article 20 (2) of the Regulation,
    2. the Consumer did not declare, simultaneously with giving their consent under point (ba), that they acknowledge losing their right under Article 20 of the Regulation, or
    3. the Trader failed to provide the confirmation required by Article 12 (2) or Article 18 of the Regulation.

7.25. Procedure for Exercising the Right of Withdrawal:

7.25.1. If the Consumer wishes to exercise the Right of Withdrawal, they are obliged to notify the Service Provider of their intention to withdraw via the Service Provider's contact details.

7.25.2. The Consumer exercises their Right of Withdrawal within the deadline if they send/make their declaration of withdrawal before the expiry of the 14th day from the receipt of the product. In the case of written withdrawal, it is sufficient to send the declaration of withdrawal within 14 days.

7.25.3. In case of withdrawal, the Consumer is obliged to return or hand over the ordered product to the Service Provider's address without delay, but no later than within 14 days from the communication of their declaration of withdrawal. The deadline is considered met if the product is dispatched before the expiry of the 14-day period (i.e., it does not have to arrive within 14 days). The customer bears the direct costs associated with the return of the goods due to the exercise of the Right of Withdrawal. If the Trader also sells the goods in a physical store, and the Consumer exercises their Right of Withdrawal in person at the Trader's store, they are entitled to return the goods to the Trader at the same time.

7.25.4. The Consumer may also exercise their Right of Withdrawal during the period between the date of conclusion of the contract and the date of receipt of the product.

7.25.5. In the case of the sale of multiple products, if the delivery of the individual products occurs at different times, the customer may exercise the Right of Withdrawal within 14 days from the receipt of the last delivered product, or, in the case of a product consisting of multiple items or pieces, from the receipt of the last delivered item or piece.

8. COMMERCIAL GUARANTEE, STATUTORY WARRANTY

Statutory Warranty and Commercial Guarantee for Automotive Parts – Important Professional Distinction:

1. General Automotive Parts (Statutory Warranty of Conformity):
Pursuant to the applicable legal regulations (specifically Government Decree 151/2003 (IX. 22.) and IM Decree 10/2024 (VI. 28.)), the vast majority of parts installed in motor vehicles (e.g., mechanical parts, wear-and-tear items, brake, chassis, engine, and drivetrain components) DO NOT qualify as durable consumer goods subject to mandatory commercial guarantee. For these products, the Service Provider provides Consumers with a 2-year Statutory Warranty of Conformity in accordance with the Civil Code (1 year for businesses). To investigate the cause of a defect – if necessary for assessing the validity of the claim – the Service Provider may request the provision of documents supporting the circumstances of professional installation.

2. Products Subject to Mandatory Commercial Guarantee:
Mandatory Commercial Guarantee applies exclusively to standalone consumer goods explicitly listed in the annex of IM Decree 10/2024 (VI. 28.) (e.g., car radios, multimedia systems, navigation devices, dashcams, car alarms, battery chargers, roof racks, roof boxes, bicycle carriers) for tiered durations (1, 2, or 3 years) depending on the selling price.

Defective Performance

The Service Provider performs defectively if the service, at the time of performance, does not meet the quality requirements stipulated in the contract or by law. The Service Provider does not perform defectively if the entitled party was aware of the defect at the time of concluding the contract, or ought to have been aware of the defect at the time of concluding the contract.

In contracts between a Consumer and a Trader, any stipulation that deviates from the provisions of this chapter concerning the Statutory Warranty of Conformity and the Commercial Guarantee to the detriment of the Consumer is void.

Multiple warranty rights only apply to Users qualifying as consumers under the Civil Code.

User qualifying as a Trader: a person acting within the scope of their profession, independent occupation, or business activity.

Statutory Warranty of Conformity

8.1. In what cases may the User exercise their right to a statutory warranty of conformity?
In the event of defective performance by the Service Provider, the User may assert a claim for statutory warranty of conformity against the Service Provider in accordance with the provisions of the Civil Code.

8.2. What rights does the User have based on their claim for statutory warranty of conformity?
The User may – at their discretion – assert the following claims for statutory warranty of conformity: they may request repair or replacement, unless the fulfillment of the claim chosen by the User is impossible or would incur disproportionate additional costs for the Trader compared to fulfilling another claim. If they have not requested, or could not have requested, repair or replacement, they may demand a proportionate reduction of the consideration or – as a last resort – may withdraw from the contract. They may also switch from a chosen statutory warranty right to another, but the User shall bear the cost of the switch, unless it was justified or caused by the Trader.

The Consumer is also entitled – commensurate with the severity of the breach of contract – to demand a proportionate reduction of the consideration or to terminate the sales contract if

  1. the Trader has not carried out the repair or replacement, or has carried it out but has not performed the dismantling and reinstallation in whole or in part, or has refused to bring the goods into conformity;
  2. a repeated defect in performance has occurred, despite the Trader's attempt to bring the goods into conformity;
  3. the defect in performance is so severe that it justifies an immediate price reduction or immediate termination of the sales contract; or
  4. the Trader has not undertaken to bring the goods into conformity, or it is evident from the circumstances that the Trader will not bring the goods into conformity within a reasonable period or without significant inconvenience to the Consumer.

If the Consumer wishes to terminate the sales contract citing defective performance, the burden of proof that the defect is minor shall rest with the Trader.

The Consumer is entitled to withhold part or all of the remaining purchase price – proportionate to the severity of the breach of contract – until the Trader fulfills its obligations regarding the conformity of performance and defective performance.

The reasonable period for carrying out the repair or replacement of the goods shall be calculated from the time the Consumer notified the Trader of the defect.

The Consumer must make the goods available to the Trader for the purpose of repair or replacement.

In the case of a contract between a Consumer and a Trader, the Trader must ensure the return of the replaced goods at its own expense. If the repair or replacement requires the removal of goods that were installed in accordance with their nature and purpose – before the defect became apparent – then the obligation to repair or replace includes the removal of the non-conforming goods and the installation of the replacement or repaired goods, or bearing the costs of removal and installation.

The reduction of the consideration is proportionate if its amount corresponds to the difference between the value of the goods due to the Consumer in the event of conforming performance and the value of the goods actually received by the Consumer.

The Consumer's right to terminate the sales contract under the statutory warranty of conformity can be exercised by means of a legal declaration addressed to the Trader, expressing the decision to terminate.

If the defective performance affects only a specific part of the goods supplied under the sales contract, and the conditions for exercising the right to terminate the contract exist with respect to those goods, the Consumer may terminate the sales contract only with respect to the defective goods, but may also terminate it with respect to any other goods acquired together with them, if the Consumer cannot reasonably be expected to retain only the conforming goods.

If the Consumer terminates the sales contract in its entirety or with respect to a part of the goods supplied under the sales contract, then

  1. the Consumer must return the goods concerned to the Trader at the Trader's expense; and
  2. the Trader must promptly refund the purchase price paid by the Consumer for the goods concerned, as soon as the goods or proof of their return has been received.

8.3. What is the deadline for the User to enforce their Statutory Warranty of Conformity claim?
The User (if considered a consumer) is obliged to notify the defect without delay after its discovery, but no later than two months from the discovery of the defect. At the same time, we draw your attention to the fact that Statutory Warranty of Conformity rights cannot be enforced beyond the two-year limitation period from the performance of the contract (1 year in the case of businesses or used products). (For products with an expiry date, the Statutory Warranty of Conformity can be enforced until the end of the expiry period).

If, in the case of goods containing **digital elements**, the sales contract provides for the continuous provision of digital content or a digital service for a specified period, the Trader is liable for any defect in the goods related to the digital content or digital service if the defect

  1. occurs or becomes discoverable within two years from the performance of the goods in the case of continuous service for a period not exceeding two years; or
  2. occurs or becomes discoverable during the entire period of continuous service in the case of continuous service for a period exceeding two years

occurs or becomes discoverable.

8.4. Against whom can the User enforce their Statutory Warranty of Conformity claim?
The User can enforce their Statutory Warranty of Conformity claim against the Service Provider.

8.5. What other conditions apply to the enforcement of Statutory Warranty of Conformity rights (if the User is considered a consumer)?
Within 1 year from the performance, there are no other conditions for enforcing a Statutory Warranty of Conformity claim beyond notifying the defect, provided the User proves that the product or service was provided by the Trader operating the webshop. However, after 1 year from the performance, the User is obliged to prove that the defect identified by the User already existed at the time of performance.

Product Warranty

8.6. In what cases may the Consumer exercise their Product Warranty rights, and what rights are available to the Consumer based on a Product Warranty claim?
In the event of a defect in a movable item, the Consumer may, at their discretion, exercise their Statutory Warranty of Conformity rights or assert a Product Warranty claim in accordance with the provisions of the Civil Code.
As a Product Warranty claim, the Consumer may request the repair or replacement of the defective product.

8.7. Against whom can the Consumer assert their Product Warranty claim?
The Consumer may exercise their Product Warranty rights against the producer or distributor of the product (hereinafter collectively referred to as: manufacturer).

8.8. In what cases is a product considered defective?
A product is defective if it does not meet the quality requirements effective at the time of its placement on the market, or if it does not possess the characteristics described by the manufacturer.

8.9. What is the deadline for the Consumer to assert their Product Warranty claim?
The Consumer may assert their Product Warranty claim within two years from the date the product was placed on the market by the manufacturer. After this deadline, this right is forfeited.

8.10. What burden of proof applies when asserting a Product Warranty claim?
When asserting a Product Warranty claim, you must prove that the product defect existed at the time the product was placed on the market by the manufacturer.

8.11. In what cases is the manufacturer exempt from its Product Warranty obligation?
The manufacturer is exempt from its Product Warranty obligation if it can prove that

  • the product was not manufactured or placed on the market within the scope of its business activities, or
  • the defect was not discoverable at the time of its placement on the market according to the state of science and technology, or
  • the product defect resulted from the application of a legal regulation or a mandatory official requirement.

The manufacturer only needs to prove one reason to be exempt.

Please note that for the same defect, the Consumer may assert a claim under Statutory Warranty of Conformity against the Trader and a claim under Product Warranty against the manufacturer simultaneously and in parallel. In the event of a successful Product Warranty claim, the Consumer may thereafter only assert their Statutory Warranty of Conformity claim concerning the replaced product, or the part of the product affected by the repair, against the manufacturer.

Commercial Guarantee (for new durable consumer goods)

8.12. In what cases may a Consumer exercise their right to a Commercial Guarantee?
In the event of defective performance, the Service Provider is obliged to provide a commercial guarantee pursuant to Government Decree 151/2003 (IX. 22.) on the mandatory guarantee for certain durable consumer goods, if the user qualifies as a Consumer.

A Consumer is defined as

  1. a consumer as defined by Act V of 2013 on the Civil Code (Ptk.), or
  2. a micro, small, or medium-sized enterprise acting outside the scope of its profession, independent occupation, or business activity

8.13. What rights does a Consumer have and within what deadlines based on the Commercial Guarantee?
The duration of the mandatory guarantee, according to the current legislation (Government Decree 151/2003), is tiered based on the gross sales price of the consumer good:

  1. For a sales price reaching 10,000 HUF (approx. €25) but not exceeding 250,000 HUF (approx. €625), the guarantee period is two years (or equivalent in EUR at the time of purchase);
  2. For a sales price above 250,000 HUF (approx. €625), the guarantee period is three years (or equivalent in EUR at the time of purchase).

Failure to meet these deadlines results in forfeiture of rights.

The guarantee period commences on the date of handover of the consumer good to the Consumer, or, if installation is performed by the Service Provider or its representative, or another person authorized for installation, it commences on the day of installation.

If the Consumer arranges for the installation of the consumer good more than six months after its handover, then the start date of the guarantee period shall be the date of handover of the consumer good.

The Consumer may, at their discretion, submit their claim for repair directly at the Service Provider's registered office, any of its premises, branch offices, and at any repair service indicated by the Trader on the guarantee certificate.

Based on their guarantee claim, the entitled party may, at their discretion,

  1. may request repair or replacement, unless the fulfillment of the chosen guarantee right is impossible, or if it would result in disproportionate additional costs for the obligor – compared to the fulfillment of another guarantee claim – taking into account the value represented by the service in its flawless state, the severity of the breach of contract, and the harm caused to the entitled party by the fulfillment of the guarantee right; or
  2. may request a proportionate reduction of the consideration, or may withdraw from the contract, if the obligor has not undertaken the repair or replacement, cannot fulfill this obligation within (...), or if the entitled party's interest in repair or replacement has ceased.
    Withdrawal is not permitted for minor defects.

Aim for 15-Day Resolution

Pursuant to Section 5 of Government Decree 19/2014 (IV. 29.) NGM on the procedural rules for handling warranty and guarantee claims concerning goods sold under a contract between a consumer and a trader, the Service Provider must endeavor to carry out the repair or replacement within a maximum of 15 days. If the duration of the repair or replacement exceeds 15 days, the Service Provider is obliged to inform the consumer about the expected duration of the repair or replacement. This information shall be provided with the consumer's prior consent, electronically or by other means suitable for verifying receipt by the consumer.

If the Product is Deemed Irreparable

If, during the guarantee period, in the event of a defect in the consumer good, it is determined by the Service Provider that the consumer good is irreparable, unless the consumer provides otherwise, the Service Provider is obliged to replace the consumer good within 8 days. If replacement of the consumer good is not possible, the Service Provider is obliged to refund the purchase price to the consumer within 8 days.

If the product fails for the fourth time

If, during the commercial guarantee period, the consumer product fails again after being repaired three times, - unless the consumer specifies otherwise - the Trader is obliged to replace the consumer product within eight days. If replacement of the consumer product is not possible, the Trader is obliged to refund the purchase price indicated on the guarantee certificate, or, in its absence, on the document presented by the consumer proving payment for the consumer product – an invoice or receipt issued under the Value Added Tax Act – to the consumer within 8 days.

Failure to repair within 30 days

If the consumer product is not repaired by the 30th day following the notification of the guarantee claim to the Trader, - unless the consumer specifies otherwise - the Trader is obliged to replace the consumer product within 8 days following the unsuccessful expiry of the thirty-day deadline. If replacement of the consumer product is not possible, the Trader is obliged to refund the purchase price indicated on the guarantee certificate, or, in its absence, on the document presented by the consumer proving payment for the consumer product – an invoice or receipt issued under the Value Added Tax Act – to the consumer within 8 days following the unsuccessful expiry of the 30-day repair deadline.

The above three provisions do not apply to electric bicycles, electric scooters, quads, motorcycles, mopeds, passenger cars, motorhomes, caravans, trailer caravans, trailers, and motorized watercraft.

8.14. When is the Trader exempt from its Commercial Guarantee obligation?
The Service Provider is exempt from its Commercial Guarantee obligation only if it proves that the cause of the defect arose after performance. Please note that the Consumer may simultaneously and in parallel assert claims for Statutory Warranty of Conformity and Commercial Guarantee, as well as Product Warranty and Commercial Guarantee, for the same defect. However, if the Consumer has successfully asserted a claim arising from defective performance for a given defect (e.g., the trader replaced the product), they cannot claim it again on a different legal basis for the same defect.

8.15. The Service Provider is not liable under the Commercial Guarantee for damages resulting from natural wear and tear/obsolescence beyond the guarantee period (professionally expected lifespan).

8.16. Furthermore, the Service Provider is not liable under the Statutory Warranty of Conformity or Commercial Guarantee for damages resulting from faulty or negligent handling, excessive use, or influences differing from those specified, or other improper use of the products after the transfer of the risk of damage.

8.17. If the Consumer asserts a claim for replacement due to a defect in the consumer product within three working days from the purchase or commissioning, the Service Provider cannot invoke disproportionate additional costs under Section 6:159 (2) a) of the Civil Code and is obliged to replace the consumer product within eight days, provided that the defect hinders its proper use. If replacement of the consumer product is not possible, the Trader is obliged to immediately refund the purchase price indicated on the guarantee certificate, or in its absence, on the document presented by the Consumer proving payment for the consumer product – an invoice or receipt issued under the Value Added Tax Act – to the Consumer.

8.18. What additional requirements may be imposed as a condition for exercising Commercial Guarantee rights?
Special requirements (e.g., periodic inspection) may be imposed on the Consumer for the proper commissioning or maintenance of a consumer product, provided that proper commissioning or maintenance cannot be ensured otherwise, and the fulfillment of the requirement does not impose a disproportionate burden on the Consumer.

8.19. The list of consumer goods subject to mandatory guarantee can be found here: Decree No. 10/2024 (VI. 28.) IM on the definition of the scope of durable consumer goods subject to mandatory guarantee

9. PROCEDURE IN CASE OF STATUTORY WARRANTY OR COMMERCIAL GUARANTEE CLAIM

(FOR USERS QUALIFYING AS CONSUMERS)

9.1. In contracts between a consumer and a trader, the agreement of the parties may not deviate from the provisions of Government Decree 19/2014 (IV. 29.) NGM on the procedural rules for handling statutory warranty and commercial guarantee claims concerning goods sold under a contract between a consumer and a trader, to the detriment of the consumer.

9.2. The Consumer is obliged to prove the conclusion of the contract (with an invoice or even just a receipt).

9.3. Costs related to the fulfillment of the statutory warranty obligation shall be borne by the Service Provider (Civil Code Section 6:166).

9.4. The Service Provider is obliged to draw up a record of the Consumer's statutory warranty or commercial guarantee claim reported to them.

9.5. A copy of the record must be made available to the Consumer without delay, in a verifiable manner.

9.6. If the Service Provider cannot make a statement regarding the feasibility of the Consumer's statutory warranty or commercial guarantee claim at the time of its notification, it is obliged to inform the Consumer of its position – including the reasons for rejection in case of rejection of the claim and the possibility of recourse to the Conciliation Body – within five working days, in a verifiable manner.

9.7. The Service Provider is obliged to retain the record for three years from the date of its creation and to present it upon request of the supervisory authority.

9.8. The Service Provider must endeavor to carry out the repair or replacement within a maximum of fifteen days. If the duration of the repair or replacement exceeds 15 days, the Service Provider is obliged to inform the Consumer of the expected duration of the repair or replacement. The information shall be provided, with the Consumer's prior consent, electronically or in another manner suitable for proving receipt by the Consumer.

10. MISCELLANEOUS PROVISIONS

10.1. The Service Provider is entitled to use a subcontractor to fulfill its obligations. The Service Provider shall be fully liable for the subcontractor's unlawful conduct as if it had committed the unlawful conduct itself.

10.2. If any part of these Regulations becomes invalid, unlawful, or unenforceable, it shall not affect the validity, legality, and enforceability of the remaining parts.

10.3. Should the Service Provider not exercise a right to which it is entitled under these Regulations, the failure to exercise such right shall not be deemed a waiver of that right. Any waiver of a right is valid only if made in an express written declaration. The fact that the Service Provider does not strictly adhere to any essential term or condition of these Regulations on one occasion does not mean that it waives its right to insist on strict compliance with that term or condition in the future.

10.4. The Service Provider and the User shall endeavor to settle their disputes amicably.

10.5. For matters not regulated in these General Terms and Conditions and for the interpretation of the contract, the provisions of Hungarian law shall apply. For legal disputes between the parties – if the User qualifies as a consumer – the mandatory jurisdiction rules laid down in consumer protection and civil procedure legislation shall apply.

10.6. The Service Provider does not apply different general access conditions regarding access to products in the webshop for reasons related to the User's nationality, place of residence, or place of establishment.

10.7. The Service Provider – with regard to the payment methods it accepts – does not apply different conditions to the payment operation for reasons related to the User's nationality, place of residence or establishment, the location of the payment account, the place of establishment of the payment service provider, or the place of issuance of the cash-substitute payment instrument within the European Union.

10.8. The Service Provider complies with REGULATION (EU) 2018/302 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on addressing unjustified geo-blocking and other forms of discrimination based on customers' nationality, place of residence or place of establishment within the internal market and amending Regulations (EC) No 2006/2004 and (EU) 2017/2394 and Directive 2009/22/EC.

11. COMPLAINT HANDLING PROCEDURE

(IN THE CASE OF USERS QUALIFYING AS CONSUMERS)

11.1. The Service Provider's objective is to fulfill all orders with appropriate quality and to the complete satisfaction of the customer.

11.2. The Consumer may submit their complaint to the Trader verbally or in writing.

11.3. The Trader shall immediately investigate verbal complaints and remedy them as necessary.

11.4. If the Consumer does not agree with the handling of the complaint, or if immediate investigation of the complaint is not possible, the Trader shall immediately draw up a record of the complaint and its position regarding it, and shall proceed according to the rules applicable to written complaints.

11.5. The Trader shall provide a copy of the record to the Consumer

  1. in the case of a verbal complaint made in person, hand it over on the spot,
  2. in the case of a verbal complaint made by telephone or using other electronic communication services, send it at the latest simultaneously with the substantive reply – unless the Consumer has not provided all their data necessary for handling the complaint, as per point 11.8.

11.6. Verbal complaints made by telephone or using electronic communication services must be assigned a unique identification number by the Trader.

11.7. The record drawn up regarding the complaint must contain the following:

  1. the Consumer's name, address, or email address,
  2. the place, time, and manner of submitting the complaint,
  3. a detailed description of the Consumer's complaint, a list of documents, papers, and other evidence presented by the Consumer,
  4. the Trader's statement regarding its position on the Consumer's complaint, if immediate investigation of the complaint is possible,
  5. the signature of the person who drew up the record and – with the exception of verbal complaints made by telephone or using other electronic communication services – the Consumer's signature,
  6. the place and time of drawing up the record,
  7. in the case of a verbal complaint made by telephone or using other electronic communication services, the unique identification number of the complaint, and
  8. a warning regarding the provisions of paragraph 11.8.

11.8. If the Consumer fails to provide the data specified in points 11.7 a) and c) during the recording of the minutes, or refuses to sign the minutes as per point 11.7 e), the Trader shall disregard the application of the provisions of point 11.9 during the handling of the verbal complaint.

11.9. The Trader shall – unless a directly applicable legal act of the European Union provides otherwise – respond to the written complaint in writing in a verifiable manner within thirty days of its receipt and arrange for its communication. A shorter deadline may be set by regulation, a longer deadline by law. The Trader is obliged to justify its position if it rejects the complaint.

11.10. If the Trader provides an electronic interface or form for submitting written complaints, it is obliged to immediately confirm the receipt of the written complaint at the email address provided by the Consumer.

11.11. The Trader is obliged to retain the minutes recorded about the verbal complaint or the written complaint, as well as a copy of its substantive response to the complaint, for three years, and to present it upon request by the supervisory authority.

11.12. In the event of the rejection of a complaint, the Trader is obliged to inform the Consumer in writing about which authority or Conciliation Body they may initiate proceedings with, depending on the nature of their complaint. The information must also include the registered office, telephone and internet contact details, and postal address of the competent authority or the Conciliation Body corresponding to the Consumer's domicile, place of residence, or registered office. The information must also cover whether the Trader has made a general declaration of submission.

11.13. The Trader may refrain from investigating a repeated complaint made by the same Consumer that is identical in content to a previously substantively answered complaint and contains no new information, as well as a consumer complaint made by an unidentifiable person.

11.14. We inform you that in the event of the rejection of your complaint, you may initiate proceedings with an authority or a Conciliation Body, as follows (the Service Provider has not made a general declaration of submission):

11.15. The Consumer may lodge a complaint with the consumer protection authority:
Pursuant to Section 45/A (1)-(3) of the Consumer Protection Act and Government Decree 326/2024 (XI. 14.) on the designation of the consumer protection authority, the government office acts as the general consumer protection authority: https://kormanyhivatalok.hu/kormanyhivatalok

11.17. The Conciliation Body is responsible for the out-of-court settlement of consumer disputes. The task of the Conciliation Body is to attempt to reach an agreement between the parties for the purpose of settling a consumer dispute, and if unsuccessful, to make a decision in the matter to ensure the simple, quick, effective, and cost-efficient enforcement of consumer rights. Upon request by the Consumer or the Service Provider, the Conciliation Body provides advice regarding the rights and obligations of the Consumer.

In the conciliation body procedure, in the absence of an agreement, the board shall decide on the merits of the case by

  1. issuing a binding resolution if
    1. the request is well-founded, and the trader – in its general declaration of submission under Section 36/C, registered with the Conciliation Body or the Chamber, or communicated in its commercial communications – acknowledged the decision of the Conciliation Body as binding upon itself at the start of the procedure or at the latest by the time the decision is made, or
    2. the trader has not made a declaration of submission, but the request is well-founded and the consumer's claim to be enforced – neither in the request nor at the time of issuing the binding resolution – does not exceed two hundred thousand Hungarian Forints (200,000 HUF, approx. €500), or
  2. making a recommendation if the request is well-founded, but the trader declared at the start of the procedure that it does not acknowledge the board's decision as binding, or if it did not make any declaration regarding the acknowledgment of the board's decision.

11.18. In the case of a cross-border consumer dispute, the Conciliation Body designated by the minister responsible for consumer protection (Budapest Conciliation Body) is authorized to act.

11.19. The Trader is obliged to cooperate in the conciliation body proceedings and, within this framework, must send its statement of defence to the conciliation body with the content specified in the Consumer Protection Act (Fgytv.) and within the deadline mentioned therein. The Trader must ensure the participation of a person authorised to reach a settlement at the hearing. At an online hearing, the Trader's representative authorised to reach a settlement must participate online. If the Consumer requests a personal hearing, the Trader's representative authorised to reach a settlement must participate at least online in the hearing.

11.20. If the Consumer does not turn to a conciliation body, or if the procedure does not lead to a resolution, the Consumer has the option to turn to a court to settle the legal dispute. The lawsuit must be initiated with a statement of claim, which must include the following information:

  • the court hearing the case;
  • the names, residences, and procedural status of the parties and their representatives;
  • the right to be enforced, with a presentation of the facts serving as its basis and the evidence thereof;
  • the data from which the court's jurisdiction and competence can be determined;
  • a definite request for the court's decision.

The statement of claim must be accompanied by the document, or a copy thereof, whose content is referred to as evidence.

  4. adapting, processing, modifying, translating, or incorporating into other content;
  5. using for commercial, advertising, search engine optimization, data collection, competitive, or other business purposes;
  6. using for training, teaching, analysis, or data extraction by artificial intelligence-based systems, data mining tools, automated data collection applications, or other software solutions, unless expressly consented to by the Service Provider.

12.4. The prohibition set forth in point 12.3 does not affect cases of fair use as defined in the Copyright Act, particularly the possibility of lawful quotation, provided that the quotation is made to the extent justified by the purpose, faithfully to the original, with the source and – where indicated – the author acknowledged. Cases of fair use cannot be interpreted expansively and cannot serve as a basis for systematic, business-oriented, or competitive appropriation of the website's content.

12.5. The legal documents available on the website – including, but not limited to, the General Terms and Conditions and the privacy policy – serve to inform visitors and users. Visitors may download, store, and use these documents for their own information, legal practice, or to understand their existing or planned legal relationship with the Service Provider. However, this provision does not entitle the visitor, user, or any third party to exploit these documents commercially, as their own service, as content for other websites, or as part of an activity competing with the Service Provider.

12.6. Placing a link to the https://jpparts.eu website is permitted, provided that the link does not harm the Service Provider's reputation, does not create the false impression that cooperation, approval, endorsement, or any other business relationship exists between the linking person or entity and the Service Provider, and does not constitute unlawful or unfair market conduct.

12.7. The name https://jpparts.eu, the website's image, appearance, distinctive structural and visual elements, and designations suitable for identifying the Service Provider's services are related to the Service Provider's economic activity. Their unauthorized use, imitation, or application in a manner that may lead to confusion with the Service Provider, its services, or its website, or may result in unfair exploitation of the Service Provider's market performance, is prohibited.

12.8. Should a third party, without authorization, take over, copy, publish, use for commercial purposes, adapt, present as their own, use without source attribution, or exploit the website's content within the scope of an activity competing with the Service Provider, the Service Provider, or the affected author or other rights holder, may take action based on the Act on Copyright, the Civil Code, and – in the event of an infringement committed by a market participant – the rules prohibiting unfair market conduct.

12.9. In the event of an infringement, the Service Provider, or the affected author or other rights holder, may assert, in particular, the following claims:

  1. judicial determination of the infringement;
  2. cessation of the infringement and prohibition of the infringer from further infringement;
  3. removal, deletion, or rendering inaccessible of the infringing content, and restoration of the state preceding the infringement;
  4. provision of appropriate satisfaction and its publication at the infringer's expense;
  5. restitution of unjust enrichment obtained through the infringement;
  6. payment of damages;
  7. payment of compensation for non-pecuniary damage (sérelemdíj) in case of infringement of the author's moral rights;
  8. provision of data related to the infringement, particularly data concerning the manner, duration, extent, accessibility, revenue, and commercial exploitation of the infringing use;
  9. reimbursement of notary, expert, legal, technical, and other justified costs necessary for proving and ceasing the infringement.

12.10. The Service Provider explicitly states that the provisions contained in this chapter do not constitute a penalty clause and do not establish contractual fines. Through these provisions, the Service Provider informs website visitors, users, and third parties about the existing reservations of rights under copyright law, civil law, and competition law. In the event of an infringement, the Service Provider, or the author or other rights holder concerned, shall assert their claims directly based on the relevant legal provisions.

12.11. The Service Provider hereby gives prior notice that in the event of unauthorized, commercial, or competitive content appropriation, it will take into account the severity, extent, repetitive nature of the infringement, the manner of use, the quantity of content used, the financial benefit gained by the infringer, and any potential infringement of the author's moral rights when determining its claims. In the Service Provider's view, particularly serious infringements include the commercial, uncredited, competitive, or misleading appropriation of images, product descriptions, textual content, brand elements, or databases.

12.12. The Service Provider is entitled, upon detection of an infringement, to utilize notary public factual certification, screenshots, electronic evidence preservation, expert examination, or other means of proof. The Service Provider may enforce its reasonably incurred costs in connection therewith against the infringer based on the relevant legal provisions.

12.13. If the infringement is committed by an undertaking, competitor, or other market participant, and the adoption of content, imitation of distinctive elements of the website, use of the Service Provider's designations, or exploitation of the Service Provider's market performance is capable of unfair advantage, deception, confusion, or prejudice to the Service Provider's legitimate interests in economic competition, the Service Provider may also take action on competition law grounds, in addition to copyright claims.

12.14. The reservation of rights contained in this chapter does not affect the Service Provider's right to assert any other civil law, copyright, competition law, criminal law, or other legal claim available to it against the infringer based on legal provisions.
